Attorney fee caps in such disputes hurt consumers and small business by taking away the only penalty an auto insurance company has when they deliberately or wrongfully choose not to pay bills that are due and owed under their policies. If the insurance company doesn’t want to pay attorneys, it can choose to pay its bills on time, and never face one dollar in penalties or attorney fees.
