Three Exceptions to Leaving the Scene of an Orlando Accident

You have just been involved in an Orlando car accident and suddenly you are faced with the legal burden as the driver to ensure the safety of everyone else involved in the crash. This can be an overwhelming feeling and may leave you or the other driver tempted to flee the scene of the accident. If you leave the scene of an accident, the crash will be deemed a “hit and run” and you face severe penalty. Still, there are a few exceptions to when you are legally able to leave the scene of your accident.

Here are three instances where leaving the scene of a crash is legally permitted:

  1. You are not the driver– Witnesses and passengers have no obligatory duty to pull over or stay at the scene of an Orlando car crash. Therefore, if a witness chooses to continue driving after seeing a crash occur, or if a passenger needs to leave for any reason, they are legally allowed to do so.
  2. If you risk further injury staying on scene– If there is risk of explosion or the crash occurred in an unsafe area, leaving the scene of an accident to move to a safe place is permitted. This is in the best interest of everyone involved in the crash, as well as any bystanders.
  3. If you as the driver are incapacitated –If you are unable to perform your legally required duties to ensure the safety of others and exchange the necessary information because of your own injuries, you will not be held responsible for not rendering aid. In this event, you must remain at the scene of the crash but you are not obligated to give the legally required assistance to others.
