Why No-Fault Insurance Is Bad for Orlando Accident Victims

In Florida, a no-fault car insurance law went into effect on January 1, 2013. This law was created to help stop insurance fraud and protect people in the event of an Orlando car accident. The problem is, the way the law was designed sets up accident victims to be put at a disadvantage rather than helping them to get the coverage they rightly deserved.

It did not take long for lawmakers,Orlando car accident lawyers, and victims to realize the impact these new rules really had on Florida residents. In March, the no-fault rules were put on hold while a judge promised to look through them and make a ruling on the law.

As an Orlando resident, you have a right to be concerned. Here’s a few ways the Florida no-fault law could have a negative impact on you.

  • You may miss the quick deadline to seek medical attention –Under the new law, you only have 14 days to seek medical attention. While this may seem like plenty of time, many Orlando auto accident injuries do not start to show their symptoms until days or weeks after the collision. If you try to tough out your pain and don’t see a doctor in time, you could miss your deadline for medical care coverage.
  • You may not have all of your injuries covered –Whiplash and traumatic brain injuries are two common ailments caused by accidents that take time to appear. Under the new law, you may not be able to seek compensation for these injuries if you do not seek treatment right away. Treating these injuries takes time and money. You deserve to have the costs associated with these injuries covered.
  • You may not receive the compensation you deserve for your injuries –Only certain doctors are able to diagnose and determine the extent of your injuries. This means that you may not be able to see the doctor who will benefit you the most. If the doctor you do see determines that you have a non-emergency medical condition, the amount you receive in compensation dramatically decreases, leaving you to pay for the negligence of others.
